In Utah, an uncontested divorce can be finalized in as little as 30 days after the mandatory waiting period. A contested divorce — where spouses disagree on property, custody, or support — typically takes 6 to 18 months depending on the complexity of the issues and the court’s schedule. Having experienced legal representation can help move the process forward efficiently.

Utah courts determine child custody based on the best interests of the child. Judges consider factors including each parent’s relationship with the child, the child’s adjustment to home and school, each parent’s willingness to support the other’s relationship with the child, and any history of domestic violence or substance abuse. Utah law recognizes both legal custody (decision-making) and physical custody (where the child lives).

A legal separation in Utah allows spouses to live apart and divide assets, debts, and custody arrangements without legally ending the marriage. This can be appropriate for couples with religious objections to divorce, those who want to maintain certain benefits like health insurance, or those who are uncertain about ending the marriage permanently. A divorce legally terminates the marriage entirely.

Commercial litigation refers to legal disputes between businesses or individuals arising from business relationships. This includes breach of contract claims, partnership disputes, collections matters, business torts, fraud, and enforcement of judgments. Weekes Law represents both plaintiffs and defendants in commercial litigation throughout Utah courts.

A small business should consult a business attorney when forming an entity, drafting or signing significant contracts, facing a dispute with a partner, customer, or vendor, dealing with an employment issue, or planning to buy or sell the business. Having legal counsel before problems arise is almost always less expensive than resolving issues after they escalate.

A creditor rights attorney represents lenders, businesses, and individuals who are owed money. This includes pursuing collections through litigation, navigating bankruptcy proceedings where the debtor has filed for protection, enforcing judgments, and recovering secured or unsecured debt. Weekes Law represents creditors in both state court and U.S. Bankruptcy Court in Utah.

Generally, when a debtor files for bankruptcy, an automatic stay immediately halts most collection efforts. However, creditors have rights in bankruptcy proceedings — they can file proofs of claim, object to a debtor’s discharge, and pursue relief from the automatic stay in certain circumstances. An experienced creditor rights attorney can help you protect your interests during a debtor’s bankruptcy.

Both serve important purposes. A will directs how your assets are distributed after death but must go through probate — a court-supervised process that takes time and costs money. A revocable living trust transfers assets to your beneficiaries without probate, offers more privacy, and can provide for management of your assets if you become incapacitated. Many Utah families benefit from having both. An estate planning attorney can help you determine the right approach for your situation.

A comprehensive basic estate plan in Utah typically includes a last will and testament, a revocable living trust, a durable power of attorney for finances, a health care directive (living will), and a health care power of attorney. Business owners may also need a succession plan. Weekes Law helps Utah families build estate plans tailored to their specific goals and family circumstances.

Legal fees vary depending on the type of matter, its complexity, and the amount of time involved. Weekes Law is committed to transparent pricing and efficient representation. We discuss fees clearly during your initial consultation so you understand the likely costs before moving forward. Some matters are handled on a flat fee basis; others are billed hourly.
